TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, BREEZY VACATION RENTALS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. BREEZY VACATION RENTALS DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

7. Limitation of Liability

IN NO EVENT SHALL BREEZY VACATION RENTALS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, LOSS OF USE, OR LOSS OF DATA, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF THE SITE, THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON THE SITE, OR THE DELAY OR INABILITY TO USE THE SITE, EVEN IF BREEZY VACATION RENTALS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of laws provisions. You agree that any action at law or in equity arising out of or relating to these Terms shall be filed only in the state or federal courts located in Las Vegas, Nevada, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.

9. Entire Agreement

These Terms constitute the entire agreement between you and Breezy Vacation Rentals with respect to your use of the Site, and they supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Breezy Vacation Rentals with respect to the Site. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck from these Terms and the remaining provisions shall remain in full force and effect.
